PetMaison Partners Program Terms

1. Who we are
PetMaison Partners is the partner program of PetMaison, the brand behind the stores petmaison.pt, petmaison.fr, petmaison.es and petmaisonstore.com, hereinafter "PetMaison" or "we".
We use "partner" for any person or company whose application has been accepted.
2. Application and acceptance
2.1. You apply at partners.petmaison.pt. To do so, you must be at least 18 years old and provide true and current information.
2.2. We review each application and accept or decline it at our own discretion, with no obligation to justify our decision. A partnership only exists once the application has been accepted.
2.3. Each person has a single account. The account is personal and non-transferable, and the Partner is responsible for whatever is done with their credentials.
3. Your code and your links
3.1. Each Partner receives a personal discount code and personal links. The code gives their followers the discount we set, shown on the portal.
3.2. The code and the links are for the Partner's use on their own channels. They may not be transferred, sold or published by third parties.
3.3. We may change the code's discount, with notice on the portal, or deactivate it in the cases set out in point 11.
4. How a sale is attributed to you
4.1. An order is attributed to the Partner when:
a) it has the Partner's code; or
b) it has no partner's code and was placed within 30 days of the person clicking one of the Partner's links. The last link clicked counts, and only if that person accepted cookies on the store.
4.2. The code always beats the link. If an order has one partner's code but comes from another partner's link, the sale belongs to the owner of the code.
4.3. Not attributed: purchases made by the Partner themselves, with their own code or through their own links; test orders; orders that were never paid.
4.4. Attribution is made from our system's records. If you believe a sale of yours was not attributed, contact us within 30 days. We review the case, and our decision on the records is final, except in case of manifest error.
5. Commission
5.1. The commission is a percentage of the order value excluding VAT and shipping, after discounts. The rate in force is always shown on the portal. The program's standard rate is 10%, and we may agree a different rate with each Partner.
5.2. The rate that applies is the one in force on the day the order is paid. A rate change is announced on the portal at least 14 days in advance and applies only to subsequent orders.
5.3. The commission arises when the order is paid, including pre-order orders.
6. Returns, cancellations and refunds
6.1. If an order is cancelled or refunded, in whole or in part, after the commission has been calculated, the corresponding commission is voided in the same proportion.
6.2. The voided amount is deducted from subsequent payments. The Partner's balance may go negative. A negative balance is not charged: it is offset against future commissions.
7. Payments
7.1. We pay every Monday the commissions for orders paid up to the previous Sunday, at 23:59 (Lisbon time). If Monday is a public holiday in Portugal, we pay on the next business day.
7.2. Minimum amount: €20. A balance below that carries over to the following week and is added to whatever comes next.
7.3. We pay by PayPal, the preferred method, or by bank transfer to the account shown on the portal, always in euros. PayPal and transfer fees are borne by PetMaison: the Partner receives the full statement amount. We are not liable for payments that fail due to incorrect details provided by the Partner.
7.4. Each payment appears on the portal with the week's statement and the transaction reference.
7.5. The Partner is responsible for their tax and reporting obligations in their country of residence.
7.6. We may withhold payments while we review a suspected breach of these terms. We inform the Partner of the withholding and aim to complete the review within 30 days.
8. How to promote PetMaison
8.1. Promote honestly: talk about your real experience and the products' true characteristics.
8.2. Always identify advertising, clearly and visibly, in line with the rules of your country (for example, "#ad", "#partnership" or the platform's paid partnership label).
8.3. Do not make claims about animal health or safety, and do not promise guarantees, deadlines or conditions beyond those published on the store.
8.4. Use the portal's materials or your own content. Do not use third-party photographs, videos or texts without authorization.
9. What is not allowed
It is not allowed to:
a) run paid ads (Google, Meta, TikTok or others) using the PetMaison brand, product names or variations of them as a keyword, in the ad's text or in the ad's destination address, without our written authorization;
b) publish the code or the links on coupon and discount sites, code aggregators, forums or discount-sharing groups;
c) give the code or the links outside your own channels, or send them in unsolicited messages (spam);
d) present yourself as PetMaison or as our customer support, or create profiles, pages or domains using the PetMaison brand;
e) generate artificial clicks, cookies or orders, including orders placed to receive a commission and then cancelled;
f) buy with your own code or links for your own use or for resale.
10. Brand and content
10.1. We authorize the Partner, on a limited, non-exclusive and revocable basis, to use the PetMaison brand and the portal's materials only to promote PetMaison within the scope of this program.
10.2. Content created by the Partner remains theirs. The Partner authorizes PetMaison to use the content they publish about PetMaison, including their image and voice appearing in it, on the website, on social media and in paid ads, at no additional payment, for as long as the partnership lasts and for up to 12 months after it ends.
10.3. We may adapt the format (cuts, captions, dimensions), but never in a way that changes the meaning of what the Partner said. When sharing on social media, we always credit the author.
11. Suspension and end of the partnership
11.1. Either party may end the partnership at any time: the Partner through the portal, we by notice on the portal or by email.
11.2. If these terms are breached, we may suspend the account immediately. Commissions on sales linked to the breach are not owed.
11.3. When the partnership ends, we deactivate the code and the links. Commissions valid up to that date are paid in the next cycle, even if they fall below the €20 minimum.
12. Relationship between the parties
The Partner acts independently. These terms do not create an employment, agency, partnership or exclusivity contract: the Partner may work with other brands. The Partner may not enter into commitments on PetMaison's behalf.
13. Personal data
13.1. We process the Partner's data (name, email, social media, country, payment details and activity within the program) to manage the program and make payments. The legal basis is the performance of this agreement and, for payment records, our legal obligations.
13.2. We keep the data for as long as the partnership lasts and, after that, for as long as required by law. Declined applications are deleted after 6 months.
13.3. The Partner may request access, rectification, erasure or portability of their data, or object to its processing, through the email in point 16, and may lodge a complaint with the data protection authority of their country.
13.4. We never share our customers' data with the Partner. The Partner sees their sales by order number, date and value.
14. Liability
PetMaison is not liable for lost profits, loss of opportunities or indirect damages linked to the program, nor for temporary interruptions of the portal. The Partner is liable for the content they publish and for compliance with the advertising rules that apply to them. Nothing in these terms limits liabilities that the law does not permit to be limited.
15. Changes to these terms
We may change these terms. We give notice on the portal at least 14 days in advance and request renewed acceptance. If you disagree, you may end the partnership before the new version takes effect, under the conditions in point 11.3.
16. Governing law and contact
16.1. These terms are governed by Portuguese law. Disputes are settled by the competent Portuguese courts, without prejudice to the mandatory rules of the Partner's country of residence.
